Anthony Coles is involved in all areas of intellectual property practice, concentrating on patent evaluations for patent pool licensing, patent infringement litigation, client counseling, and patent procurement. Anthony has worked on patent litigation in the areas of video compression (MPEG-2), digital broadcast television (ATSC), mobile media, object-oriented software, and semiconductor manufacturing. A registered attorney before the U.S. Patent & Trademark Office, he has worked on Patent Office post-grant proceedings (IPRs) in the areas of mobile media, consumer disposables, and biologics.
Anthony has experience across many technical areas, including optical discs, mobile media, digital rights management, wireless communications, video compression, cryptography, computer software, networking, computer architecture, optics, semiconductors, consumer disposables, and medical products.
Patent Evaluation and Review:
Anthony has assisted clients in evaluating and licensing patents pertaining to certain standards. An important part of this process is determining whether the patents are essential for implementing certain technical standards. Furthermore, he helps draft the agreements for forming and managing the pool under which essential patents are made available in a single license. He has appeared before the European Commission Directorate General for Competition in connection with patent pools. He has made such appearances to answer questions in connection with a pool license.
Patent Litigation:
Anthony has helped his clients assert their patents in the U.S. and other countries, including Germany, France, Denmark, and the UK. He has helped some of the largest consumer electronics companies assert their patents pertaining to MPEG-2 compression and ATSC digital television system against various computer, broadcast television equipment, DVD disc, DVD player, and television set manufacturers and distributors.
Among other dispute related services, Anthony helps his clients choose which patents to assert.
Anthony’s patent litigation experience covers video compression (MPEG-2), digital broadcast television (ATSC), mobile media, object-oriented software, and semiconductor manufacturing. He also has extensive knowledge on RAND (“reasonable and nondiscriminatory”) damages recoverable for infringement of standard essential patents. Anthony has successfully defended his clients against allegations of anticompetitive conduct.
Patent Licensing, Counseling, and Procurement:
Anthony counsels clients on licensing, patent procurement, and other issues of infringement and validity. He advises on patent portfolio purchases, including review of the patents and potentially infringing products and has provided noninfringement/invalidity opinions to clients in connection with specific patents and right-to-use/freedom to operate opinions with regard to specific products. Anthony provides patent procurement advice in “high stakes” applications being considered for licensing or enforcement or that are from patent families involved in litigation.
