What Exactly Does The Deputy Commissioner For New Covered Persons Oversee?

Since I served as Commissioner of Corporations in the 1990s, the Department of Corporations has consolidated with the Department of Financial Institutions and changed its name twice. It is now known by the unwieldy name of "Department of Financial Protection & Innovation". Although the DFPI no longer oversees health maintenance plans (aka HMOs), its regulatory oversight has expanded to include the California Consumer Financial Protection Law.

Recently, I happened upon a new title at the DFPI that did not exist in my time as Commissioner - Deputy Commissioner For New Covered Persons. Being filled with "satiable curtiosity", I inquired as to what this position actually involved. According to the DFPI's website, "new covered persons" refers to providers of financial products and services previously unregulated by the Department and which are subject to oversight. The newly covered products and services include:

  • Credit repair and consumer credit reporting companies;
  • Debt relief companies;
  • Debt collectors;
  • Private, for-profit school funding.

I have one cavil - the title of this position should be "Deputy Commissioner for Newly Covered Persons" rather than "Deputy Commissioner for New Covered Persons". Using of the adverb "newly" would make it clear that the persons are newly covered whereas the adjective "new" suggest that the covered persons are in their nonage.
