So I noticed some other law firms were reporting on the fairly modest 9.3% increase in TCPA filings in 2023.

Per usual #biglaw is missing the big picture.

Yes TCPA filings were up overall but TCPA class actions–the cases that really matter–were up over 18%. Yikes!

But that’s not all. Focusing on the last 5 months of the year, TCPA class actions from Aug-December, 2023 were up 29%! 

That means the clip of TCPA class actions increased in the back half of 2023.

Also interesting, the percentage of TCPA cases filed as class actions in 2022 was only 49%. The percentage of TCPA cases filed as class actions in 2023 was 53.5%–a small but meaningful increase.

But the percentage of TCPA cases filed as class actions from Aug-Dec., 2023 was 61.4%– an absolutely ABSURD statistic.

Without question something is going on here. The small time TCPA filers are making room for the massive class action sharks.

Bottom line, with an 18.7% increase year over year in raw TCPA class action count the risk of a massive TCPA suit crippling your business is definitely increasing!
