On January 16, 2025, the non-profit organization, None Of Your Business (“NOYB”), filed six complaints against organizations with five European data protection authorities for the unlawful transfer of personal data to China. NOYB cited the absence of an adequacy decision for China and the inability for importers in China to guarantee the same level of data protection as in the European Union (“EU”).
Under the complaints, NOYB requests that the data protection authorities immediately order the suspension of data transfers to China on the basis that China does not provide an essentially equivalent level of data protection under the EU General Data Protection Regulation (“GDPR”), and requests that the organizations bring their processing into compliance with the GDPR. In addition, NOYB calls for administrative fines to be imposed on the organizations.
