Quick update last week I spread the news that New York had passed an amendment in both the Senate and Assembly and was awaiting the Governor’s signature. And just as I thought, it was signed into law yesterday. The effects of this new amendment to section 399-z are immediate. Violating this section of New York’s telemarketing law will now cost you up to $20,000 per violation.
Section 399-z regulates call time restrictions, oral disclosure, and DNC requirements among a few others.
Governor Hochul is quoted as saying “Every day, hard-working New Yorkers are forced to field call after call from relentless telemarketers. Today, we’re raising the penalty for violators of the Do Not Call Registry to deter telemarketers, protect New Yorkers, and send a clear message that New York won’t tolerate these frustrating, unsolicited calls.”
Make sure you are up to date on the requirements under this section so you do not find yourself on the other end of a massive penalty!
