Mixed Ruling Upholds Arizona's 'Show Your Papers' Provision

On September 5, U.S. District Court Judge Susan Bolton issued a mixed ruling in the closely watched case over Arizona’s “show your papers” provision, which was upheld by the U.S. Supreme Court in its landmark case invalidating much of the state’s hard-line immigration law, SB 1070. According to the ruling, the law’s challengers failed to show that they were likely to prevail on the merits of the case. However, Judge Bolton noted that the nation’s highest court did not foreclose a challenge to the provision after it goes into effect, effectively requiring law enforcement to investigate the immigration status of individuals who are detained and suspected of being in the U.S. illegally.

In addition, Judge Bolton issued a preliminary injunction to block an SB 1070 provision which criminalizes the transport, shielding or harboring of undocumented immigrants in Arizona. Three other provisions had already been struck down under the Supreme Court’s ruling.
