Here are the most recent health care related regulatory developments as published in the New Jersey Register on February 20, 2018:

  • On February 20, 2018 at 50 NJR 883, the Office of the Governor published Executive Order Number 4, which mandates that all state entities facilitate enrollment in the Affordable Care Act marketplace.

  • On February 20, 2018 at 50 NJR 885, the Office of the Governor published Executive Order Number 6, which mandates that the Department of Health and the State Board of Medical Examiners review all aspects of the medical marijuana program to remove any potential obstructions.

  • On February 20, 2018 at 50 NJR 905, the Department of Banking and Insurance published notice of its readoption of its rules governing loss ratio and refund reporting requirements, as well as requests for relief from obligations imposed by the Individual Health Insurance Reform Act.

  • On February 20, 2018 at 50 NJR 906, the State Board of Nursing published notice of its readoption with amendments to its rules governing general requirements of licensure, continuing education, and certification of advanced practice nurses. Advanced practice nurses must complete the education required in the regulations no more than two years prior to submitting the application for certification to the Board of Nursing.

  • On February 20, 2018 at 50 NJR 917, the Office of the Attorney General published notice of its denial of a petition for rulemaking seeking to permit email submission of Open Public Records Act (“OPRA”) request to agencies within the Department of Law and Public Safety. In denying the petition, the Office of the Attorney General indicated that the on line OPRA request process better assures that a requestor meets the requirements of OPRA and case law by including the specific elements for a valid OPRA request set forth as in the OPRA statute.
