FCC Announces Tentative Agenda for June 8, 2023 Open Meeting: FCC to Discuss Recent NPRM On TCPA Revocation Rules

As the Czar just reported, the FCC has recently issued another NPRM potentially impacting the realm of TCPAWorld. The latest NPRM is aimed at strengthening consent requirements and codifying rules on revocation of consent and ensuring consumers can readily opt out of receiving robocalls and text messages.

The comment deadline is 30 days after date of publication in the Federal Register. It has yet to be published in the Federal Register. Obviously we will continue to keep an eye on this.

In the meantime, the FCC has announced its June agenda which will include:

Strengthening Consumer Consent for Robocalls and Robotexts – The Commission will consider a Notice of Proposed Rulemaking proposing rules to strengthen the ability of consumers to decide which robocalls and robotexts they wish to receive by exercising their right to grant and revoke consent to callers. The item also proposes to codify the Commission’s past guidance on prior express consent to make these requirements more apparent to callers and consumers. (CG Docket No. 02-278).

Jessica Rosenworcel also articulated  her expectations for next month’s meeting:

“We’re empowering consumers to block robocalls and robotexts. One of the most frustrating things about unwanted robocalls and robotexts is the feeling that there’s little you can do to stop them. We’re working to fix that. The Commission will consider a proposal to strengthen the ability of consumers to decide which robocalls and robocalls they wish to receive. Specifically, it would make sure guidance on consumers’ rights to control consent to be contacted is more apparent and easily accessible. It would also propose to close loopholes that allow certain callers to make robocalls and robotexts without consent and without the ability for the consumer to opt out.”
