Virginia Mixon Swindell

Professional Biography

Ms. Swindell has successfully represented employers in individual and class litigation, appeals, and administrative agency proceedings in all types of employment disputes, including breach of contract, state law wrongful discharge, whistleblower retaliation, discrimination and harassment, FMLA leave and disability management, Fair Labor Standards Act, and ERISA claims. Ms. Swindell also has represented management in labor litigation and arbitration, including in disputes over interpretation of collective bargaining agreements. Prior to joining Jackson Lewis, Ms. Swindell also represented clients in commercial and securities investigations, litigation and arbitration.

Ms. Swindell also enjoys helping her clients prevent lawsuits. She regularly counsels employers regarding discipline and performance management, disability and military leave management, and wage and hour compliance. Ms. Swindell prepares and reviews employee handbooks and policies and conducts audits of human resources processes, including FLSA classification audits. Ms. Swindell also assists clients with internal investigations of employee complaints and misconduct.
