Professional Biography

Jennifer Martin is a member of Winstead’s Real Estate Development & Investments Practice Group. Jennifer has broad experience in planned community and condominium law having represented HOAs, homebuilders, developers, and investors.

Most recently, she served as Corporate Counsel – HOA and Community Management at a $17.3B real estate investment, development, and operating company. In that role, she applied her deep understanding of complex planned community governance to large-scale acquisitions and dispositions as well as daily community operations. This in-house experience informs her representation of clients to proactively address their needs.

Jennifer has extensive experience drafting, amending, and interpreting governing documents, including CC&Rs, bylaws, and rules, as well as acting as general counsel to HOAs related to compliance, insurance, and enforcement matters. She has assisted developers in documenting public improvement district (PID) and municipal utility district (MUD) agreements. Additionally, she has negotiated resolutions to allegations of fair housing violations faced by “housing providers,” including in-depth research into the potential disparate impact of rental restrictions in common interest developments.

Routinely, Jennifer participates in speaking engagements to inform and educate real estate industry professionals as to the opportunities and potential pitfalls that HOAs pose.

In addition, she has experience diffusing high-tension conflicts within HOAs and handling sensitive matters related to high-profile members of HOAs.
