Amy E. Smith is a staff attorney and member of the firm’s Environmental Department.
Ms. Smith’s practice focuses primarily on remediation projects dealing with soil, ground water and surface water contamination under both state and federal regulatory programs. She concentrates on underground storage tank (UST) regulatory and Indiana Excess Liability Trust Fund (ELTF) matters. As former lead program counsel at the Indiana Department of Environmental Management (IDEM) for both the ELTF program and UST branch, she has knowledge of state and federal UST laws and regulations that directly affect UST owners, operators and their consultants.
Prior to joining Barnes & Thornburg, Ms. Smith spent nearly a decade at IDEM serving in a variety of roles. The majority of her practice at IDEM concentrated on Indiana’s UST program, particularly on agency implementation of state UST technical requirements, UST financial responsibility, corrective action requirements and IDEM’s administration of the ELTF including eligibility, claims and reimbursement from the state fund. Additionally, she represented the state agency in enforcement and administrative proceedings.
