NJDEP Extends Certain Site Remediation Deadlines

Following up on a Compliance Alert advising that all regulatory requirements remain in place, the New Jersey Department of Environmental Protection (“NJDEP”) announced late last week that it was extending certain regulatory timeframes applicable to the remediation of contaminated sites.  The specific timelines are set forth in the Administrative Requirements for the Remediation of Contaminated Sites (a/k/a the “ARRCS”) and Technical Requirements for Site Remediation (a/k/a the “Tech Reqs”), which contain the bulk of NJDEP’s rules governing site remediation.

In short, NJDEP is providing a 90-day extension of deadlines that have passed or will pass while the current state of emergency is in effect. In the notice regarding the extension of timeframes, NJDEP also stated that it may waive, suspend, modify, or relax other provisions of its site remediation rules on a case-by-case basis.  The full notice can be accessed here.
