My Zoom Deposition is in Three Weeks – No Problem

Let’s imagine that your Zoom deposition is going to take place a few weeks from today.  This is great news, because it means that not only will you will finally get to tell your side of the incident, but your case is also that much closer to being resolved. Remember to always remain truthful in your deposition.

So what will the defense attorney ask you during the deposition? Most likely the defense attorney will cover the following three areas in this order: Biographical; Day of the Incident; and “So What?”

Biographical

This area of the deposition is exactly what it sounds like; the defense attorney will be asking you biographical questions, such as: How old are you? Are you married? Do you have any children? How far did you go in school? What do you do for a living? Did you miss anytime from work because of the crash? Where you ever hurt before this crash? Have you ever filed any other lawsuits? Where you ever hurt after this crash? Have you ever served in the military? Do you have a criminal record?

As always, it is extremely important that you provide truthful answers to all of the defense attorney’s questions. Since no one knows you better than yourself, the easy part of your deposition is to truthfully answer the questions asked.

Day of the Incident

For the second part of your deposition, the defense attorney will want to know exactly what happened on the day you were injured. What time of day was the incident? Where did it happen? Where were you going? Why were you going there? Was anyone with you? Were you paying attention right before it happened? Where were you looking? Did you report your incident to anyone? Did the police come? Where you hurt? How were you hurt? What hurt? Did you require medical attention?

If you don’t remember something, it is perfectly fine to let them know that you don’t recall the information requested. In fact, this is a much better response than trying to guess the answer. All you have to do is provide truthful answers to these questions, which will be easy for you to do, because you did nothing wrong.

So What?

This is the final and most important part of your deposition. By the time the defense attorney covers this area, you may be exhausted, since you have probably been answering questions for a couple of hours at this point. Do not worry- the deposition is almost finished, and it is important that you remain focused.

The defense attorney will be asking you questions about all of your injuries, the medical treatment you received, and how the incident has impacted your life.  This part of your deposition is so important because you need to explain to the defense attorney how this crash changed your life, giving reason for the insurance company to fully compensate you. Insurance companies value cases based upon injuries, medical treatments, and how the accident changed your life.

Your attorney is probably already preparing you for your deposition and covering all of these areas. As long as you tell the truth during your deposition, everything will work out.
