Happy New Year: What Happened To My E-Verify Records?

As 2015 comes to close, Employers should heed recent notifications from the Department of Homeland Security (DHS), US Citizenship and Immigration Services (USCIS) that it will begin purging employer E‑Verify records.  USCIS informed [PDF] that in accordance with the National Archives and Records Administration (NARA) records retention and disposal schedule (N 1‑566‑08‑7), it will dispose of E‑Verify records that are over 10 years old every January 1st.

E‑Verify users will have until December 31, 2015 to download and save historic E‑Verify data older than ten years via the “Historic Records Report.” Instructions for creating this report [PDF] are available on the Questions and Answer of the E‑Verify website.

It’s a good idea to capture this information while it is still available. Employers using E‑Verify are required to annotate Forms I‑9 with the E‑Verify case verification number or append a print‑out of the case result with the I‑9.
