On November 4, 2021, the U.S. Department of Labor’s Occupational Safety and Health Administration announced a new emergency temporary standard, which is set to be published tomorrow, November 5, 2021. Under this new standard, employers with 100 or more employees will be required to develop and implement a mandatory COVID-19 vaccination policy or an alternative, which involves requiring additional safety measures for unvaccinated employees. In this special briefing, we will address the preliminary highlights of the new standard, including specific issues of concern to employers, such as how to treat remote workers, whether to allow for weekly COVID-19 testing, and where to start with implementation.
