Yelena (Lena) Greenberg has experience advising clients on health care regulatory compliance and transactional matters. Lena advises healthcare clients such as hospitals and health systems, long-term care facilities, provider group practices, and clinical laboratories, as well as universities and colleges with respect to their student health and counseling centers and clinical programs. She is a member of our firm's Health Law practice group and Education industry group.
Health Care Regulatory + Transactional Matters
Lena advises healthcare clients on regulatory compliance with fraud and abuse laws such as the Stark Law, Anti-Kickback Statute, prohibition against beneficiary inducements under the Civil Monetary Penalties Law, the Eliminating Kickbacks in Recovery Act, and applicable state corollaries. Lena also advises clients on compliance with health care privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA), 42 C.F.R Part 2, and confidentiality obligations under professional licensure laws.
Lena also negotiates various professional health services agreements, clinical affiliations, and vendor service agreements, and counsels healthcare facility clients on federal and state licensing approvals and determinations of need.
In addition, Lena is knowledgeable on matters involving 340B Program compliance and counsels clients on day-to-day program compliance, contract pharmacy arrangements, and implications of the ongoing legal challenges and legislative developments.
Health Care in Higher Education
Lena provides tailored legal support for higher education clients’ health care compliance needs, including negotiating health care services agreements with external clinical providers, such as student health and behavioral health service providers, telehealth software platforms for service delivery, and team physician arrangements. Lena has extensive experience counseling higher education clients on negotiating and structuring their external clinical affiliations, and maintaining compliance with confidentiality and privacy obligations under HIPAA, the Family Education Rights and Privacy Act (FERPA), and state professional and clinic licensing requirements.
Community Involvement
Lena is a staunch supporter of career development in the legal profession. Lena is an alumni of the Rappaport Fellowship Program of the Rappaport Center for Law and Public Policy. She participates as a mentor for current students selected for the Fellowship, as well as a mentor for the Boston University School of Law, Health Law Mentorship Program. Lena also supports women’s economic empowerment as a Career Coach for the Dress for Success Organization.
Before becoming an attorney, Lena worked in health policy and research at the Harvard School of Public Health in the areas of surgical safety improvement, medical liability reform, and in studies evaluating the Affordable Care Act.
