Michael R. Guerrero’s practice is focused on helping clients navigate the requirements of highly regulated, consumer-focused industries including consumer financial services, telemarketing, residential solar and home improvement contracting, charitable fundraising and e-commerce.
He advises clients on federal and state compliance matters including issues relating to the Fair Credit Reporting Act (FCRA), Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Electronic Funds Transfer Act (EFTA), Electronic Signatures in Global and National Commerce Act (ESIGN), Telephone Consumer Protection Act (TCPA), and state laws relating to retail installment sales and sales finance programs, installment lending, licensing, debt collection, home improvement contracting and financing, sweepstakes and giveaways, telemarketing and the use of autodialers.
Prior to joining Ballard Spahr LLP he held in-house positions at companies ranging from an e-commerce start-up to a publicly traded debt buyer. His experience includes the oversight of legal and compliance efforts associated with the launch of an alternative payment-based credit sale product as well as the management of licensing for both a publicly traded debt buyer/collector and a mortgage lender.
