Professional Biography

Kerry Bundy helps clients solve disputes around the globe, protect trade secrets and defend their franchises. She represents clients in trade secret litigation and counseling, franchise and distribution litigation, non-compete cases, international arbitration, and complex commercial litigation. Kerry has litigated in more than 25 states and conducted arbitrations under the ICC, AAA, ICDR, CIETAC, HKIAC, LCIA and JAMS Rules. She is also the co-editor and contributing author of the acclaimed book, The Secrets to Winning Trade Secret Cases, Thomson West (2009, 2012 and 2016).

Trade Secret Litigation & Counseling

Kerry handles trade secret cases that relate to non-disclosure agreements, restrictive covenants, licensing disputes and corporate espionage claims. She helps companies protect their valuable trade secrets, as well as defend against allegations of misappropriation. She has extensive experience counseling on trade secret protection programs, clean rooms and reverse engineering projects, as well as training employees on confidentiality best practices.

Franchise and Distribution Litigation 

Kerry represents franchisors and manufacturers in litigation, arbitration and mediation. She represents companies across various industries, including food and beverage, retail, leisure and fitness, health care, hospitality, and commercial and consumer services. Her experience spans disputes relating to claims of violation of state franchise or dealership laws, trademark infringement, breach of contract, system-standards enforcement, consumer class actions, post-termination rights, disclosure and registration issues, fraud claims, vicarious liability, independent contractor misclassification, and joint employment issues.
