Ms. Black represents employers and individual defendants in a broad range of employment litigation, including the defense of harassment and wrongful termination claims, claims of age, disability, gender, marital status, national origin and race discrimination, retaliation, leaves of absence, failure to provide reasonable accommodations, breach of employment contracts, non-solicitation and covenants not to compete, intentional tort and unfair business practices, individual and class action wage and hour lawsuits and other complex employment litigation matters.
Ms. Black has represented numerous employers in their successful efforts to enforce the arbitration of individual putative class member’s claims while staying the underlying putative class action pursuant to enforceable arbitration agreements. Ms. Black has also represented numerous employers in their successful efforts to defeat class certification of various wage and hour claims, including but not limited to, claims for allegedly unpaid wages, violation of Labor Code Section 204 requiring payment of wages within seven days after the end of a payroll period within which wages are earned, inaccurate wage statements, missed breaks and overtime exempt misclassification. Ms. Black has negotiated favorable settlements for clients at mediation, arbitration and via information negotiations. Ms. Black has advised employers about workplace issues, including employee misconduct, leaves of absence, reductions in force and compliance issues. Ms. Black has also assisted clients in developing employee handbooks and personnel policies. Ms. Black regularly conducts anti-sexual harassment trainings and general human resources training, both in English and in Spanish.
Prior to joining Jackson Lewis, Ms. Black practiced exclusively labor and employment law as a partner in the Los Angeles office of a California-based labor and employment firm. Prior to that, Ms. Black practiced employment law and general commercial litigation in a large, national general practice firm.
