Dana Breitman focuses her practice on all aspects of intellectual property development and protection, with an emphasis on domestic and international structure, clearance, prosecution, enforcement and licensing of trademarks and copyrights. She counsels clients in an array of industries, including finance, entertainment, hospitality, technology, cannabis, sports, beauty and pharmaceutical.
She has extensive experience prosecuting trademark applications at the US Patent and Trademark Office (USPTO), as well as initiation, prosecution, settlement negotiation and defense of oppositions and cancellations at the Trademark Trial and Appeal Board (TTAB). Dana prepares cease and desist letters, cautionary and closure communications with potential infringers and prepares numerous confidentiality, assignment and settlement agreements. Additionally, she prepares and negotiates trademark licenses, counsels clients regarding intellectual property strategies for website design and the internet, domain name clearance, registration and enforcement. Dana handles UDRP prosecution, copyright clearance, registration, maintenance and enforcement. She also conducts review and analysis of IP diligence for leveraged finance, private equity and M&A transactions.
Dana provides clients with a comprehensive marketing strategy, clearance and protection. She executes a creative approach to settlement negotiations in trademark disputes.
Dana maintains an active pro bono practice primarily focused on affirmative gender and political asylum cases.
