Chuck Macdonald represents lenders in loan and mortgage enforcement proceedings, including foreclosures by action and advertisement, property receivership actions and contract for deed cancellations. He also advises on real estate-related litigation, including mortgage foreclosure defense litigation.
Foreclosures and Workouts
Chuck represents lenders during workouts and foreclosures of loans secured by real estate. He negotiates:
- Workout agreements, including those with forbearance periods
- Voluntary mortgage foreclosure agreements
- Deeds in lieu of foreclosure
- Appointments of receivers
- Confessions of judgment
If and when remedies must be pursued, he pursues foreclosures (both by advertisement and by action), the appointments of receivers and the collection of deficiencies from guarantors.
Real Estate Litigation
Chuck litigates real estate disputes including:
- Representing clients in landlord-tenant disputes, commercial eviction actions and rent collection actions
- Litigating quiet title and adverse possession actions
- Representing lenders in disputes concerning mortgage priorities and title insurance claims
- Representing both buyers and sellers in litigation over purchase agreements and contracts for deed
