The Classified Information Procedures Act, or CIPA, impacts both discovery and the flow of a trial. Whether addressing the security clearance process, notice requirements for using classified information at trial, or proposed non-classified substitutes, practitioners need to have a working knowledge of the statute’s requirements in the event that classified information arises during the course of federal criminal litigation.
