Well its 4:20 on a Friday so I guess that means its time for a little Cannabis news
Just this week we dropped our HUGE interview with Morgan Fox of the National Cannabis Industry Association–its getting big reviews BTW– in a bid to spread awareness of the threat of TCPA suits to the Cannabis industry.
With the help of the trade organization this critical issue really seems to be making its way to the forefront of the the minds of many cannabis industry participants.
Unfortunately it may already be too late for one Michigan-based cannabis outfit– Green Peak Industries, dba Skymint, which was just hit in a big putative TCPA class action yesterday.
The suit–available here Montanez complaint–seeks over $5,000,000.00 in damages related to purportedly unwanted text messages. Screenshots appear to show that Skymint offered deals on pot via text message- a real no no if the messages were sent using an ATDS without consent.
The Plaintiff seeks to represent two nationwide classes–including a DNC class although she, herself, does not allege that her number was on the national DNC.
