I remember when that company Sly Dial came along I thought– that name is going to get them in trouble.
But apparently somebody has developed an automated outreach platform and just went ahead and called it “Robotalker” which inadvertently seems to combine the words “robocall” and “stalker” in a very unfortunate way.
Regardless robotalker.com was just sued in a TCPA class action alleging the company made robocalls to a website visitor without consent.
Per the Plaintiff DIEDRICH THIESSEN Robotalker sent her a prerecorded voicemail back in March without her consent.
The plaintiff–represented by Manny Hiraldo– seeks to represent a class of:
TCPA Robocall Class: All persons within the United States
who, within the four years prior to the filing of this lawsuit
through the date of class certification, received one or more
prerecorded voice calls regarding Defendant’s property,
goods, and/or services on their cellular telephone line.
So nationwide class of everyone who received a prerecorded call regarding Robotalker’s services regardless of who made the call.
Alot of problems with this class definition, obviously, but will be interesting to see how Robotalker responds regardless.
Will keep an eye on this.
