On November 14, 2023, the Pesticide Registration Improvement Act (PRIA) Coalition hosted a webinar for the U.S. Environmental Protection Agency (EPA) to provide an overview of the process improvement to release Data Evaluation Records (DER) to the registrant with the final registration decision, as mandated under the Pesticide Registration Improvement Act of 2022 (PRIA 5). PRIA 5 requires EPA to release to the applicant at the decision review time the complete DERs for studies submitted by the applicant in support of the application.
Lynn Vendinello, EPA Director of Communication and Information Services, Office of Program Support (OPS), stated that this automated process is expected to begin in early 2024. Obtaining a registrants own DERs for previous actions and other application documents will continue to require filing a Freedom of Information Act (FOIA) request. Non-PRIA action DERs also will not be included in the new process.
The DERs will be provided to the applicant using GoAnywhere, a managed file transfer solution for entities to send and receive information securely. Vendinello stated that the DER file provided by EPA will be password protected and the link to download the document will expire 45 days after it is sent. If the DER is not downloaded before the expiration date, then filing a FOIA request will be the only option to obtain the DER.
