Litigation has taken place in St. Louis, Missouri relative to claims that talcum powder particles produce ovarian cancer while the defense points to science that declares that no such link has been proven as the defense asserts, in part, that there is a lack of properly controlled epidemiological studies.
Daubert v. Merrill Dow requires that expert causation opinion be the product of a reliable scientific methodology. Whether or not a jurisdiction applies, Daubert will be of critical importance going forward.
The verdicts rendered in St. Louis are on appeal but possible additional plaintiffs wait in the wings for what may prove to be continued litigation.
