Rodney Hudson regularly represents pharmaceutical, medical device and technology companies in complex litigation, including product liability, mass torts, consumer fraud, class actions and commercial litigation. Over more than two decades in private practice, Rodney has represented clients in eight federal multidistrict litigation proceedings and six state coordinated proceedings involving thousands of cases, including serving as lead, co-lead and liaison counsel. Working closely with clients, Rodney guides nationwide legal strategy, manages teams of lawyers, and represents clients in state and federal courts across the country.
Product Liability
Rodney represents clients in complex, coordinated proceedings, at trial and on appeal. He has served as a member of numerous trial teams in jurisdictions around the country and secured many important victories through dispositive motions before trial, including summary judgment based on federal law preemption in a mass tort proceeding involving thousands of cases. He also has prevailed on many Daubert and Kelly/Frye motions to exclude expert testimony, resulting in dismissals of cases, and has secured dismissals of claims brought by foreign plaintiffs who filed suit in the United States. Rodney also represents clients on appeal before state and federal appellate courts.
State Regulation and Risk Management
Rodney provides strategic advice and represents clients whose business operations may be hindered due to state regulatory action. He recently argued on behalf of one of his clients for the suspension of a state agency’s regulations because federal law preempted the regulation, allowing a global client to continue to do business in the state. Rodney also assists clients with regulatory compliance and risk management before litigation commences. He also counsels clients on liability exposure of target companies during merger and acquisition due diligence.
Privacy and Data Security
Rodney helps clients develop effective approaches to complying with the global patchwork of privacy and data security laws and minimizing liability exposure. He has managed data breaches involving thousands of individuals
