Professional Biography

Bob Higgins is the Senior Partner in the firm’s Creditors’ Rights and Bankruptcy Litigation practices. For over 30 years, Bob has represented lenders in the enforcement of loan documents and loan work-outs, receiverships, the defense of lender liability claims and creditor representation in Chapter 11 bankruptcy cases. In addition, Bob has a significant commercial litigation practice in both federal and state courts and, in recent years, he has handled alternative dispute resolution matters, both as an advocate for parties and as a mediator and arbitrator.

Bob’s bankruptcy work is national in scope. He has been involved in many of the major bankruptcies filed over the last several years. He represents creditors in connection with sophisticated preference, fraudulent conveyance and stay relief litigation, as well as Chapter 11 plan confirmation issues. He also provides special interest committee and Bankruptcy Trustee representation in major cases.

Bob represents lenders in the enforcement of commercial loan documents throughout Florida, and has considerable experience with multi-site and multi-state foreclosures. He has prepared sophisticated loan workout agreements and is knowledgeable in the assessment of lender liability exposure and defensive strategies.
