Benjamin N. Patterson

Professional Biography

Benjamin is a land use attorney with experience entitling projects across all major asset classes. He regularly advises developers on entitlement strategies for complex and often contentious developments, with the goal of minimizing the number of discretionary approvals and reducing the risk of the entitlements being denied or set aside by a judge. Supporting developers throughout the entire entitlement process, he advocates on their behalf to protect their rights and prevent government overreach. When necessary, Benjamin also defends the entitlements against lawsuits filed by anti-development individuals or organizations, usually claiming that the development failed to comply with the California Environmental Quality Act (CEQA).

While based in the Orange County office, Benjamin has entitled development projects in jurisdictions throughout California. He has extensive experience in navigating a wide range of local, state, and federal laws and regulations that govern real estate development, including local planning and zoning regulations, CEQA, the Coastal Act, the Subdivision Map Act, and the numerous housing laws that the State Legislature has adopted in recent years in response to the housing crisis.

When he is not helping developers secure entitlements or reading up on the latest land use updates, he is usually sailing or spending time with family.
