THAT WAS FAST: 147 TCPA Plaintiffs Team Up to Sue Former Porch Executives for $46MM Just One Day After Order Moving Suit

Gees, that was snappy.

Just yesterday I reported a court had ordered transfer of a TCPA mass action against two former executives of the company that later became Porch. The ruling was part of a broader ordered that denied most of defendant’s arguments for dismissing the suit.

Well that same day the Plaintiffs filed suit against the transferred defendants in California–where they are subject to jurisdiction– and I am impressed with the speed here.

In the new complaint–you can read here New Complaint Against Porch Executives— 147 different Plaintiffs have teamed up to sue Porch.com Inc., GoSmith Inc., Matthew Ehrlichman, CEO and co-founder of Porch.com Inc. and CEO of GoSmith, Inc., Brenton Marrelli, CEO and co-founder of GoSmith Inc., and Darwin Widjaja, CTO and co-founder of GoSmith Inc. and VP of Porch.com Inc.

The complaint seeks a meager ~$46.5MM dollars.

What I don’t understand, however, is that the suit against Ehrlickman, Porch and GoSmith continues in Seattle. So why they would be included as defendants in the new California suit doesn’t make sense to me.

Again this is all part of Tom Alvord’s impressive campaign against Porch for sending text messages to businesses (b2b!) in an effort to add pros into their network for lead generation purposes.

And, again, this case truly emphasizes the PERSONAL LIABILITY risk posed by the TCPA to employees and corporate officers of companies that are found to violate the statute.

Will be keeping a very close eye on this.
