Both the House and the Senate are considering federal trade secrets statutes. The U.S. House Judiciary Committee recently reported out proposed legislation that would create a federal private right of action for trade secrets theft (HR 5233).
Known as the Trade Secrets Protection Act, the legislation would allow civil lawsuits under the Economic Espionage Act (which currently only allows governmental action). In the Senate, the U.S. Senate Judiciary Committee is currently considering the Defend Trade Secrets Act, which would also create a federal trade secrets cause of action.
