Regulating Fracking: Zoning and States’ Interests

Regulating Fracking: Zoning and States’ Interests
Wednesday, June 12, 2013

From Jillian Bunyan of GT Philadelphia:

In her recent Pennsylvania Law Weekly article, Jillian Bunyan discusses the issue of local zoning and hydraulic fracturing (“fracking”). Ms. Bunyan uses the recent decisions of Matter of Norse Energy Corp, No. 515227, 2013 N.Y. Slip Op. 3145 (N.Y. App. Div., 3d Dept., May 2, 2013) and Cooperstown Holstein, No. 515498, 2013 N.Y. Slip Op. 3148 (N.Y. App. Div., 3d Dept., May 2, 2013) to frame the question of whether municipalities or states should regulate fracking. Ms. Bunyan considers the issue in light of the ongoing national discussion regarding fracking regulation as well as Pennsylvania’s still-outstanding Robinson Township, 52 A.3d 463 (Pa. Commw. Ct 2012).
