NLRB steps up aggressive outreach campaign — are you ready?

As reported this week in the Wall Street Journal, the NLRB soon will be taking its outreach campaign to a whole new level. In addition to the mandatory notice posting requirement for all employers that will go into effect on April 30, the NLRB will establish in the next few weeks a website dedicated to informing all employees — union and non-union — of their rights under the National Labor Relations Act, specifically, their right to engage in protected concerted activity for mutual aid or protection.

In addition, the NLRB plans to distribute pamphlets containing similar information, in English and Spanish, to worker advocacy groups and other federal agencies, as well as hit the media circuit, addressing its role in the workplace and workers’ rights in radio and television appearances by Board members. Undoubtedly, this is the most aggressive the NLRB has been in its history to make its presence known in the workplace. Employers must prepare for the possible impact of the NLRB’s actions.
