Peru’s Ministry of Production Proposes Draft Regulations Regarding Technical Specifications and Labeling Requirements for Vehicle Components

Peru’s Ministry of Production (Ministerio de la Producción) has proposed regulations setting forth technical specifications and labeling requirements for fuel system components of vehicles that run on liquefied petroleum gas (Proyecto de reglamento técnico sobre componentes del sistema de combustible para vehículos que funcionan con gas licuado de petróleo, the “Draft Regulations”).  The Draft Regulations would apply to (i) 27 components specifically listed in the Draft Regulations and (ii) certain components which meet function and performance characteristics specified in the Draft Regulations.  (Art. 2).  All such components produced, sold or imported in Peru would be subject to the Draft Regulations.  (Arts. 1, 2). 

The Draft Regulations also contain certification and labeling requirements.  Before any covered product enters the market, the importer or domestic producer would have to possess certificates of compliance with technical requirements.  (Art. 8).  The applicable technical requirements would be either the technical standards set forth in the Draft Regulations (Annex B to the regulations lists a variety of technical requirements), or equivalent standards existing abroad.  (Art. 7).  The Draft Regulations also set forth certain labeling requirements.  (Art. 5).  Violators of the Draft Regulations would be subject to sanctions.  (Art. 12).
