Christine Wyman will discuss EPA’s final Section 401 Water Quality Certification Rule, which aims to provide structure and limits on how States consider whether discharges from federally permitted projects will impact water quality. Daniel Pope will provide an update on litigation over the Navigable Waters Protection Rule, which has been challenged in multiple federal district courts across the country, and what arguments so far have been persuasive to the judges that have considered the legality of the rule.
