Using Your Contract to Mitigate Your Risk,” a one-hour Wilson Elser Forum webinar on September 19, 2025. This session will equip claims professionals, risk managers, and other professional services stakeholders with a working knowledge of the contractual provisions most commonly used to allocate and cap exposure in professional services engagements. Participants will learn (1) how waiver-of-consequential-damages and limitation-of-liability clauses function as defensive “shields” and offensive “swords”; (2) the principal enforceability rules applied by major jurisdictions such as New York and California courts; (3) drafting techniques that increase the likelihood that a provision will be upheld; and (4) practical strategies for deploying these clauses in anticipation of, and during, coverage or liability disputes.
