Lisa Handler Ackerman (Partner-Chicago IL), Richard Bortnick (Of Counsel-Philadelphia, PA), and Matthew Foree (Of Counsel-Atlanta, GA) will present “Successfully Defending a Class Action Lawsuit Isn’t as Hard as You May Think” on April 9, 2025, a Class Action Series webinar that provides an introductory discussion on determining whether a class action is “real” as opposed to an attempt to convert a single-plaintiff action into a class action for the ultimate benefit of plaintiff’s counsel. Lisa, Rick, and Matt will discuss strategies for dealing with actions that have been plead as class actions but are not appropriate for class treatment. Topics include opportunities to defend a class action that does not qualify as a “real” class action; how to analyze a complaint to determine whether it alleges a “real” class action, and approaches for using Rule 11 if it does not; and the defense of motions for class certification, including the standards under Rule 23 for certifying a class and defenses to same.
