The Kansas Senate is considering a bill that would raise the cap on non-economic damages to $300,000 in July, $325,000 in 2018 and $350,000 in 2022. Interestingly, the Kansas Chamber of Commerce is supporting the bill because of its other provisions dealing with expert testimony and collateral sources. The change in the cap is a response to an Opinion for the Kansas Supreme Court in which the Justices stated it was troubling that the caps had not been raised since 1988. Stay tuned for more information as the bill is considered.
