Mounting Media Pressure for the Residential Solar Consumer Finance Industry Sparks Concerns about Increased Regulatory Scrutiny

As more Americans install photovoltaic power generation and storage systems on their homes, journalists have reported incidents of alleged fraud and other forms of misconduct by solar system installers, finance companies, and other related parties. The media attention has correlated directly with an increase in press releases, investigations, and even lawsuits by attorneys general and other regulators in states including ArizonaConnecticutFloridaGeorgiaIdaho, and New Mexico.

Financing residential solar systems intersects with multiple sensitive areas in consumer law, including both laws governing sales and marketing efforts and laws governing lending and finance. As the popularity of residential solar continues to grow – and the need for financing for those systems increases in step – we expect the regulatory scrutiny to increase as well.
