As a member of Foley Hoag’s international litigation and arbitration practice, Tafadzwa Pasipanodya represents sovereign States in contentious and advisory matters concerning international law. She has represented numerous sovereign States in investor-state arbitrations concerning mining, the environment, and health policy under the rules of UNCITRAL, ICSID, the ICSID Additional Facility, and the ICC. Tafadzwa has also advised States from around the world in disputes against other States concerning human rights, environmental rights, territorial claims and maritime delimitations before the ICJ, UNCLOS tribunals, and other fora. In addition, she has represented foreign States in U.S. federal court proceedings.
Tafadzwa is also engaged in Foley Hoag’s corporate social responsibility practice, which advises multinational corporations on the integration of human rights and environmental standards into their business operations.
Tafadzwa also advises states and civil society organizations on sustainable infrastructure and public private partnership contracting, and has served as an independent legal expert on the law of the sea for the African Union. Her work with intergovernmental and non-governmental organizations prior to joining Foley Hoag include the prosecution of alleged genocidiaires in Rwanda; natural resources and conflict in Angola; caste discrimination in Nepal and India; U.S.-Africa policy; Roma and prisoner health in Romania; and post-conflict reconstruction in Sri Lanka.
