Our Shopping Center and Retail Development Group recently secured a multi-million-dollar settlement for a commercial landlord client’ s property damage claim that arose from an insurance coverage dispute involving a bankrupt retailer and its insurance company.*
“This case highlights our Shopping Center and Retail Development Group’s depth of knowledge in bankruptcy, litigation and insurance coverage and the ability to work together in obtaining a solid and just result for our client,” said Thomas Onder, Esq.
The case concerned a national retailer, whom the Group pursued in Bankruptcy Court to protect the client’s rights. “There were significant discovery issues and complex fact investigation into the extent and timing of the damages, including multiple expert reports and depositions within the bankruptcy case,” said Joseph McCarthy, Esq.
“The Group was able to aggressively pursue the coverage issue with the carrier, ultimately resulting in a substantial settlement,” Andrew Podolski, Esq. and Joseph Lemkin, Esq. said in a joint statement. “We remained focused on protecting our client’s position and driving toward a result that fully addressed the damages and related costs, almost dollar for dollar.”
While the details of the settlement are confidential, the settlement provided significant recovery to address the client’s damages.
