Today, July 1, 2024, Texas joins seven other states that have active consumer data privacy regulations as the Texas Data Privacy and Security Act (TDPSA) goes into effect. As we previously discussed, like its counterparts, the TDPSA specifies requirements for data privacy programs, which may require:
- Updating external privacy policies with certain disclosures;
- Implementing a process through which consumers can request access to or modification of their data;
- Implementing a process through which consumers can appeal their requests; or
- Amending contracts with third parties that have access to consumer personal data.
A Nationwide Patchwork of Data Privacy Regulations
Texas joins California, Colorado, Connecticut, Florida, Oregon, Utah and Virginia with comprehensive data privacy regulations that will be in effect beginning on July 1, 2024. An additional 12 states have passed regulations that are set to become effective between now and January 1, 2026, including Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Rhode Island and Tennessee.
