Federal Government Shutdown: Employer Issues


Effective October 1, 2013, the United States government has partially shut down its agencies and services. The shutdown is the result of Congress’s failure to pass an appropriations bill by midnight September 30, the expiration date of the latest continuing resolution appropriating funds for federal agencies.

The lack of funds for federal agencies entails a large-scale reduction in government services. This greatly affects private sector employers as most are subject to the jurisdiction of federal agencies. The longer the shutdown lasts, the more employers will be affected. It is not clear at this time if and how the shutdown might impact any applicable statutes of limitation for claims that could be filed with federal agencies. What seems certain, however, is that all applicable federal labor, employment and immigration laws and regulations remain in effect, and employers must continue to comply with them. Federal courts will continue to operate for the time being, and the Supreme Court will continue to operate when it opens October 7, 2013, as it did in previous shutdowns.
