The California Office of Environmental Health Hazard Assessment (OEHHA) announced the addition of the developmental toxicity endpoint to the reproductive toxicity listing of bisphenol S (BPS) under Proposition 65, effective December 8, 2025. The listing is based on California’s “Qualitied Experts” mechanism. The Developmental and Reproductive Toxicant Identification Committee (DARTIC) voted to approve listing BPS as a developmental toxicant at its October 9, 2025 meeting.
Also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, Proposition 65 prohibits knowingly exposing any individual to a listed chemical without first providing a “clear and reasonable warning” to such individual.
BPS was first placed on the Proposition 65 list for female reproductive toxicity in December 2023, and therefore, warnings are already in effect for this endpoint. The male reproductive endpoint was added on January 3, 2025, and those warnings go into effect on January 3, 2026. Warnings for the developmental endpoint will go into effect on December 8, 2026.
