Brazil and the European Union Reach Agreement to Recognize Mutual Adequacy in Personal Data Protection
Thursday, January 29, 2026

On January 26, 2026, the Brazilian data protection authority (“ANPD”) announced that Brazil and the European Union agreed to mutually recognize the adequacy of each other’s data protection networks. The agreement enables the free flow of personal data between Brazil and the European Union without additional transfer mechanisms. The announcement follows the November 2025 adoption of the European Data Protection Board’s generally positive opinion on the European Commission’s draft decision in the matter.

According to the ANPD, representatives from the two jurisdictions will hold a ceremony in the afternoon of January 27, 2026, in Brasilia, Brazil, to officially announce the agreement. The ceremony will be attended by Brazilian Vice President Geraldo Alckmin, EU Commissioner Michael McGrath, ANPD Director-President Waldemar Gonçalves, and various representatives of the relevant Brazilian and European authorities.
